EU Commission blocks anti-migrant petition on discrimination grounds

The European Commission has denied registration to the ‘Save Europe Act,’ a transnational petition advocating for mass remigration. By rejecting the proposal, which sought to halt non-Western migration, the Commission established a new precedent by barring a citizen initiative on the basis of its discriminatory content rather than legal competence.

The initiative aimed to leverage the European Citizens’ Initiative, a process requiring one million signatures across seven member states, to force a moratorium on non-Western migration channels. Proponents argued for the removal of both irregular migrants and specific groups of legal residents, claiming their presence burdened member states. In its refusal, the Commission cited the Court of Justice’s April 2026 ruling in Commission v Hungary, asserting that national identity claims cannot override the Union’s fundamental values of equality and non-discrimination.

While the ECI platform has previously hosted controversial campaigns—including efforts to restrict abortion access and redefine marriage—this marks the first instance where the Commission has actively policed the democratic input process based on core human rights standards. Previous rejections typically focused on the scope of EU legislative power. By choosing to block this petition, officials have signaled that the Union’s democratic machinery is not neutral ground for proposals that explicitly violate the bloc’s foundational anti-discrimination principles.
