Federal prosecutors allege that the couple utilized state power to suppress democratic opposition through arbitrary detentions and systemic violence. The indictment claims the pair presided over a regime that employed electric shock, asphyxiation, rape, and the starvation of detainees to maintain control. Maduro, 63, is specifically accused of ordering the illegal detention and torture of individuals, while 69-year-old Flores is alleged to have orchestrated similar abuses to shield her family's interests.
Defense attorneys are currently challenging the legality of the initial arrest, arguing that the former president should retain immunity for actions taken while in office. During a recent hearing, Flores’ legal team requested a transfer to house arrest citing health concerns, but US District Judge Alvin Hellerstein denied the motion, citing her status as a flight risk. The couple’s joint trial is set for June in the Southern District of New York, where they continue to contest earlier charges of narco-terrorism conspiracy.
