Judge Dismisses FBI Case, Accusing Prosecutors of Weaponizing the DOJ

Magistrate Judge Zia Faruqui delivered a sharp rebuke to the Department of Justice on Monday, dismissing criminal charges against two former FBI counterintelligence officials. He apologized to the defendants for being dragged through a process he characterized as a transparently political maneuver aimed at influencing the 2026 midterm elections.

The case against Nikki Floris and Bradley Benavides involved allegations that the two had provided false statements to Congress regarding the investigation into Hunter Biden. In an hourlong address, Faruqui dismantled the government's complaint, noting that the prosecution failed to establish probable cause. He pointed out that the majority of the cited statements were not false, and any minor inaccuracies lacked the necessary intent to deceive.

Faruqui explicitly rejected the timing of the charges, stating he would not ignore the proximity to the upcoming midterm elections. Because the case was filed as a criminal complaint rather than presented to a grand jury, the Department of Justice theoretically retains the power to seek an indictment. However, legal observers note that Washington, D.C. juries have increasingly shown skepticism toward politically charged prosecutions. The dismissal stands as a significant blow to the office of U.S. Attorney Jeanine Pirro, highlighting a growing judicial friction over the perceived weaponization of federal law enforcement.
